Strict Alcohol Advertising Law may get Social Media posting in trouble

It must be warned that Thailand has one of the strictest alcohol advertising laws in the world. The law not only covers the brewery companies, but also anyone in the Kingdom of Thailand. With social media being in our daily lives, everyone is at risks, even if it is unintended.

Let’s take quick glimpse at the law. Section 32 of the 2008 Alcoholic Beverage Control Act prohibits the following actions from occurring:

  • Posting alcoholic drinks / bottles with the brand visible
  • Posting alcoholic content that would encourage people to drink
  • Posting properties of alcoholic drinks / bottles
  • Showing appreciation for drinking alcohol
  • Urging people to taste or drink alcohol
  • Writing about alcohol even though the drinks are not available in Thailand
  • While travelling, don’t post photos of alcoholic drinks not sold in Thailand
  • Posting logo or trademark of alcoholic beverages

There is no statue of limitation as to when you made the post. As long as it contains alcohol beverage, Thai authorities can always charge you.

The punishment for the offense is one year in jail and/or a fine, not more than 500,000 baht, as well as a daily fine up to 50,000 baht until the offender fixes the problem.
